1. About Us & Acceptance

www.lethalblack.com (the "Website") is owned and operated by Real Ascend Private Limited (GSTIN: 32AAMCR5276Q1ZL), registered office at Old Door No. X/40B, (New No. XI/686), Pottakkattu Buildings, Seaport Airport Road, HMT Junction, Kalamassery, Cochin - 683503, Kerala, India, under the brand name "Lethal Black" ("we", "us", "our", "the Company"). By accessing the Website, creating an account, or placing an order, you ("you", "customer", "user") agree to be bound by these Terms & Conditions, and by our Shipping & Delivery Policy, Cancellation, Return & Refund Policy, Warranty Policy, Fair Usage & Anti-Fraud Policy, and Privacy Policy, each of which is incorporated into these Terms by reference. If you do not agree to these Terms, please do not use the Website or place an order.

2. Eligibility & Territory

•       You must be at least 18 years of age, or using the Website under the supervision of a parent or legal guardian, to place an order.

•       Products on this Website are offered for sale and delivery within India only. We are not responsible for orders placed from, or requested to be delivered to, locations outside India.

3. Products & Pricing

•       We make reasonable efforts to ensure product descriptions, specifications, images, and pricing on the Website are accurate. Product images are for illustrative purposes; actual colour and appearance may vary slightly due to display settings and photography.

•       Prices are listed in Indian Rupees (INR) and are inclusive of applicable GST unless stated otherwise. Prices may change without notice; your order is billed at the price displayed at the time of purchase.

•       In the event of a pricing or listing error, we reserve the right to cancel the affected order(s) under our Cancellation, Return & Refund Policy, with a full refund.

4. Payment Terms

•       Prepaid orders: full payment is collected online at checkout via the payment methods offered on the Website.

•       Cash on Delivery (COD): available only where a minimum advance of 10% of order value is paid online at checkout, applicable to all products including gaming keyboards and gaming chairs. The balance is collected at delivery. Full terms, including advance forfeiture and repeat-offender restrictions, are set out in our Cancellation, Return & Refund Policy and Fair Usage & Anti-Fraud Policy, which you agree to by selecting COD at checkout.

•       An order confirmation does not constitute our acceptance of the order or a guarantee of fulfilment. Acceptance occurs on dispatch, subject to the checks described in our Shipping & Delivery Policy and Fair Usage & Anti-Fraud Policy.

5. Shipping, Cancellation, Return, Refund & Warranty

These matters are governed by our separate Shipping & Delivery Policy, Cancellation, Return & Refund Policy, and Warranty Policy, all published on the Website and incorporated into these Terms. In the event of any conflict between this Section and those policies, the specific policy shall prevail on matters within its scope.

6. Fair Usage & Fraud Prevention

Use of the Website and placing of orders is subject to our Fair Usage & Anti-Fraud Policy, which sets out our order-verification rights, the Cash-on-Delivery advance and one-strike restriction rules, and our right to refuse service, cancel orders, and pursue legal remedies in cases of suspected fraud or abuse. This policy is incorporated into these Terms in full.

7. Account Responsibility

•       You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account.

•       You agree to provide accurate, current, and complete information when placing an order, including name, address, and contact details, and to promptly correct any errors.

•       We are not liable for delays, non-delivery, or failed transactions arising from inaccurate information provided by you.

8. Intellectual Property

All content on the Website — including but not limited to the "Lethal Black" name, the ROGUE, VANTAGE, and HAVOC product names, logos, product designs, photography, and written content — is the property of Real Ascend Private Limited or its licensors, and is protected under applicable Indian intellectual property law. No content may be copied, reproduced, distributed, or used commercially without our prior written consent.

9. Prohibited Conduct

You agree not to:

•       Place fraudulent, fictitious, or duplicate orders, or place orders with the intent to cancel, refuse, or abuse our return, refund, or Cash-on-Delivery terms.

•       Provide false or misleading information at checkout or during a warranty/return claim, including fabricated or manipulated photo/video evidence.

•       Use automated means (bots, scrapers) to access or interact with the Website.

•       Attempt to reverse-engineer, decompile, or interfere with the Website's security or functionality.

•       Engage in abusive, threatening, or harassing conduct toward our support staff or representatives.

Violation of this Section may result in immediate cancellation of orders, restriction or termination of your account, forfeiture of advances/store credit as described in our other policies, and legal action where warranted, in accordance with our Fair Usage & Anti-Fraud Policy.

10. Limitation of Liability

•       Our maximum liability to you in connection with any order is limited to the invoice value of the product(s) in that order.

•       We are not liable for indirect, incidental, or consequential loss or damage arising from the use of, or inability to use, our products or the Website.

•       We are not liable for delays or failures caused by courier partners, payment gateways, Octroi/local taxes, or events beyond our reasonable control (Force Majeure, Section 13).

•       Nothing in this Section limits any liability that cannot be excluded under applicable Indian law, including the Consumer Protection Act, 2019.

11. Indemnification

You agree to indemnify and hold harmless Real Ascend Private Limited, its officers, employees, and agents, from any claim, loss, or expense (including reasonable legal costs) arising from your breach of these Terms, misuse of the Website, fraudulent order activity, or violation of applicable law.

12. Privacy

Personal information collected through the Website (including name, address, contact details, order history, and payment information) is collected and processed in accordance with our Privacy Policy and the Digital Personal Data Protection Act, 2023, for purposes including order fulfilment, customer support, warranty administration, and fraud prevention. 13. Force Majeure

We shall not be liable for any failure or delay in performance caused by circumstances beyond our reasonable control, including natural disasters, fire, flood, pandemic-related restrictions, government action, strikes, or courier/logistics disruptions.

15. Governing Law & Jurisdiction

These Terms are governed by the laws of India. Subject to your statutory right as a consumer under the Consumer Protection Act, 2019 to approach a forum at your place of residence, work, purchase, or where the cause of action arose, all other disputes arising from these Terms or your use of the Website shall be subject to the exclusive jurisdiction of the courts at Kochi, Ernakulam, Kerala.

16. Severability & Amendment

•       If any provision of these Terms is found unenforceable by a competent court or consumer forum, that provision will be modified to the minimum extent necessary, and the remaining provisions will continue in full force.

•       We may amend these Terms and our related policies from time to time. Continued use of the Website after changes are posted constitutes acceptance of the revised Terms. Material changes will be dated and, where feasible, notified.

17. Entire Agreement

These Terms, together with our Shipping & Delivery Policy, Cancellation, Return & Refund Policy, Warranty Policy, Fair Usage & Anti-Fraud Policy, and Privacy Policy, constitute the entire agreement between you and us regarding your use of the Website and purchase of our products.
